Terms and Conditions

Section 1 – Introduction

These terms and conditions apply between you, the User of this App and MAHARANI HAMPTON LIMITED, the owner, and operator of this App. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the app. If you do not agree to be bound by these terms and conditions, you should stop using the app immediately.

In these terms and conditions, User or Users means any third party that accesses the app and is not either (i) employed by Maharani Hampton Limited and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Maharani Hampton Limited and accessing the App in connection with the provision of such services.

You must be at least 18 years of age to use this App. By using the App and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age.

Section 2 –  Registration

You must ensure that the details provided by you on registration or at any time are correct and complete.

To be able to order a delivery or arrange a collection you must be registered within the app.

You must inform us immediately of any changes to the information that you provide when registering by updating your personal details to ensure we can communicate with you effectively.

We may suspend or cancel your registration with immediate effect for any reasonable purposes or if you breach these terms and conditions.

You may cancel your registration at any time by informing us in writing to the address at the end of these terms and conditions. If you do so, you must immediately stop using the App. Cancellation or suspension of your registration does not affect any statutory rights.

Section 3 –  Ordering through the app

Once you have registered within the app you will be able to place a collection or delivery order.  Once you have compiled a list of items you will have the option to review your order.  On the review screen once you have inputted your card details and pressed ‘Pay Now’ your order becomes final and can not be changed or cancelled through the app.  If you want to amend or cancel you must contact the restaurant immediately on 01733 561 111 as once the order is out for delivery or ready to be collected no changes can be made.

On submitting your order using the ‘pay now’ button your payment will be processed through the secure  Stripe payment gateway.  If your payment is not authorised for any reason, your order will not be processed or sent to the restaurant.

Delivery times vary depending on the day of the week but all orders should be delivered within 60 minutes unless we are experiencing high volumes.  If there are any current substantial delays the news feed within the app will contain details so you can see before placing an order.

Section 4 – Payment

Prices within the app include VAT at 20% as standard.  Price also includes free delivery within a 4 mile radius of the restraint which is located at  56 Hargate Way, Hampton Hargate, Peterborough, PE7 8DS.  If you are further than 4 miles from the restaurant (using google maps route finder) Maharani Hampton Ltd reserves the right to cancel your order (with a full refund).  In most cases we will contact you to find a solution which may incur a delivery charge.

All payments for orders must be made through the app using a UK issued accepted credit or debit card.  You may be required to show the card used to the delivery driver or at the restaurant on collection as proof of identity. 

Section 5 – Privacy Policy

Section 6– Disclaimers

We always try to ensure that the detail on the app is up to date however we can not promise that it is accurate or complete.  We may make changes to our menu, pricing and the apps functionality without any prior notice.

If you have any allergies, intolerances or any special dietary requirements please call the branch on 01733 561 111 before placing any order.  Please do not use the “Order notes” box for your food allergies or intolerances, please contact the Restaurant directly.

Estimated times for deliveries and collections provided are only estimates. Unfortunately we can not guarantee that Orders will be delivered or will be available for collection within the estimated times.

Exclusion of terms: We provide you with access to and use of the App on the basis that, to the maximum extent permitted by law, we exclude all representations, warranties, conditions, undertakings and other terms in relation to the App and your use of it (including any representations, warranties, conditions, undertakings and other terms which might otherwise apply to the App and your use of it, or be otherwise implied or incorporated into these  App Terms, by statute, common law or otherwise ).

Section 7– Limitation of liability

Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; or (c) limit or exclude any of our or your liabilities in any way that is not permitted under applicable law.

To the extent that the App and Content are provided free of charge, we will not be liable to you for any loss or damage of any kind.

We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.

To the maximum extent permitted by law, Maharani Hampton Limited accepts no liability for any of the following:

any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;

loss or corruption of any data, database or software;

any special, indirect or consequential loss or damage.

Section 8 – General

These Website Terms shall be governed by and construed in accordance with English law. You can bring legal proceedings in respect of Website Terms in the English courts. If you live in a part of the United Kingdom other than England or any other Member State of the European Union, you can bring legal proceedings in respect of these Website Terms in either the English courts or the courts of your home country.

As a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.  Nothing in these Website Terms, including the paragraph above, affects your rights as a consumer to rely on such mandatory provisions of local law.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our app. It is your responsibility to check our app periodically for changes. Your continued use of or access to our app or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
